Diese sind Bestandteil aller Vertr\u00e4ge, die der Verk\u00e4ufer mit seinen Vertragspartnern (nachfolgend auch \u201eAuftraggeber\u201c genannt) \u00fcber die von ihm angebotenen Lieferungen oder Leistungen schlie\u00dft. Um diese Toleranzen einhalten zu k\u00f6nnen, m\u00fcssen die Mengen der vom Auftraggeber beizustellenden Waren mindestens 7% \u00fcber den rechnerisch ermittelten Mengen (Netto ohne Ausschuss) liegen. Etwaige \u00dcber- \/ Unterlieferungen sind bei der Berechnung der Ware in vollem Umfang zu ber\u00fccksichtigen.<\/span><\/p>\n<\/li>\n \t<li dir=\"ltr\" style=\"list-style-type: decimal; font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre;\" aria-level=\"1\">\n<p dir=\"ltr\" style=\"line-height: 1.38; white-space: pre;\" aria-level=\"1\">\n<p dir=\"ltr\" style=\"line-height: 1.38; margin-top: 0pt; margin-bottom: 0pt;\" role=\"presentation\"><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Der Verk\u00e4ufer ist zu Teillieferungen berechtigt, wenn<\/span><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">a) die Teillieferung f\u00fcr den Auftraggeber im Rahmen des vertraglichen Bestimmungszwecks verwendbar ist,<\/span><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">\n<\/span><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">b) die Lieferung der restlichen bestellten Ware sichergestellt ist und dem Auftraggeber hierdurch kein erheblicher Mehraufwand oder zus\u00e4tzliche Kosten entstehen (es sei denn, der Verk\u00e4ufer erkl\u00e4rt sich zur \u00dcbernahme dieser Kosten bereit).<\/span><\/p>\n<\/li>\n \t<li dir=\"ltr\" style=\"list-style-type: decimal; font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre;\" aria-level=\"1\">\n<p dir=\"ltr\" style=\"line-height: 1.38; margin-top: 0pt; margin-bottom: 0pt;\" role=\"presentation\"><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Bei vereinbarter Selbstabholung der Waren durch den Auftraggeber verpflichtet sich dieser, die fertig gestellten Teilmengen jeweils innerhalb von maximal 3 Werktagen nach Mitteilung der Versandbereitschaft durch den Verk\u00e4ufer abzuholen bzw. abholen zu lassen. Der Verk\u00e4ufer ist berechtigt, jede Teillieferung separat zu berechnen. Verweigert der Auftraggeber die Annahme einer Lieferung oder ist eine Lieferung aufgrund eines vom Auftraggeber zu vertretenden Umstandes nicht m\u00f6glich oder holt er die Ware bei vereinbarter Selbstabholung nicht innerhalb vorerw\u00e4hnter Frist ab, werden die Waren auf Kosten und Gefahr des Auftraggebers eingelagert. In einem solchen Fall haftet der Auftraggeber f\u00fcr alle zus\u00e4tzlichen Kosten, insbesondere die Transport- und Lagerkosten.<\/span><\/p>\n<\/li>\n \t<li dir=\"ltr\" style=\"list-style-type: decimal; font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre;\" aria-level=\"1\">\n<p dir=\"ltr\" style=\"line-height: 1.38; margin-top: 0pt; margin-bottom: 0pt;\" role=\"presentation\"><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Der Auftraggeber tr\u00e4gt das Risiko f\u00fcr Waren, die dem Verk\u00e4ufer von ihm oder von ihm beauftragten Dritten zur Verf\u00fcgung gestellt wurden.<\/span><\/p>\n<\/li>\n \t<li dir=\"ltr\" style=\"list-style-type: decimal; font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre;\" aria-level=\"1\">\n<p dir=\"ltr\" style=\"line-height: 1.38; margin-top: 0pt; margin-bottom: 0pt;\" role=\"presentation\"><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">F\u00fcr den Versendungskauf gilt \u00a7 447 BGB. Bei vereinbarter Selbstabholung durch den Auftraggeber oder einem von ihm beauftragten Dritten ist f\u00fcr den Gefahr\u00fcbergang der Zeitpunkt der Mitteilung der Versandbereitschaft an den Auftraggeber ma\u00dfgebend.<\/span><\/p>\n<\/li>\n \t<li dir=\"ltr\" style=\"list-style-type: decimal; font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre;\" aria-level=\"1\">\n<p dir=\"ltr\" style=\"line-height: 1.38; margin-top: 0pt; margin-bottom: 0pt;\" role=\"presentation\"><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Vom Verk\u00e4ufer in Aussicht gestellte Fristen und Termine f\u00fcr Lieferungen und Leistungen gelten stets nur ann\u00e4hernd, es sei denn, dass ausdr\u00fccklich eine feste Frist oder ein fester Termin zugesagt oder vereinbart ist. Wird Vorbehaltsware vom Auftraggeber \u2013 nach Verarbeitung\/Verbindung \u2013 zusammen mit nicht dem Verk\u00e4ufer geh\u00f6render Ware ver\u00e4u\u00dfert, so tritt der Auftraggeber schon jetzt die aus der Weiterver\u00e4u\u00dferung entstehenden Forderungen in H\u00f6he des Wertes der Vorbehaltsware mit allen Nebenrechten und Rang vor dem Rest ab. Der Verk\u00e4ufer nimmt die Abtretung an. Zur Einziehung dieser Forderungen ist der Auftraggeber auch nach Abtretung erm\u00e4chtigt. Die Befugnis des Verk\u00e4ufers, die Forderungen selbst einzuziehen, bleibt hiervon unber\u00fchrt; jedoch verpflichtet sich der Verk\u00e4ufer, die Forderungen nicht einzuziehen, solange der Auftraggeber seinen Zahlungs- und sonstigen Verpflichtungen ordnungsgem\u00e4\u00df nachkommt. Die Untersuchungs- und R\u00fcgepflicht erstreckt sich insbesondere darauf, dass die gelieferte Ware in den handels\u00fcblichen Toleranzen nach Art, Beschaffenheit, Ma\u00dfen, Passform, Farbe und St\u00fcckzahl mit der bestellten Ware identisch ist. Hinsichtlich anderer M\u00e4ngel gelten die Liefergegenst\u00e4nde als vom K\u00e4ufer genehmigt, wenn die M\u00e4ngelr\u00fcge dem Verk\u00e4ufer nicht binnen sieben Werktagen nach dem Zeitpunkt zugeht, in dem sich der Mangel zeigte; war der Mangel f\u00fcr den Auftraggeber bei normaler Verwendung bereits zu einem fr\u00fcheren Zeitpunkt erkennbar, ist jedoch dieser fr\u00fchere Zeitpunkt f\u00fcr den Beginn der R\u00fcgefrist ma\u00dfgeblich. Auf Verlangen des Verk\u00e4ufers ist ein beanstandeter Liefergegenstand frachtfrei an den Verk\u00e4ufer zur\u00fcckzusenden. font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Nach Abschluss der Produktion schickt der Verk\u00e4ufer den kompletten Ausschuss der Fertigware zur ordnungsgem\u00e4\u00dfen Entsorgung an den Auftraggeber zur\u00fcck, sofern nicht anders vereinbart.<\/span><\/p>\n<\/li>\n \t<li dir=\"ltr\" style=\"list-style-type: decimal; font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre;\" aria-level=\"1\">\n<p dir=\"ltr\" style=\"line-height: 1.38; margin-top: 0pt; margin-bottom: 0pt;\" role=\"presentation\"><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">In Ermangelung einer abweichenden Vereinbarung in Bezug auf die Mengen der vom Auftraggeber beizustellenden Materialien gilt folgendes:<\/span><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">\n<\/span><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">a) F\u00fcr den Fall, dass der Auftraggeber weniger als 7% \u00fcber der rechnerisch ben\u00f6tigten Menge beistellt, ist der Verk\u00e4ufer berechtigt, dem Auftraggeber die \u00fcbersch\u00fcssigen Materialien, die vom Verk\u00e4ufer zugekauft wurden, einschlie\u00dflich etwaiger Entsorgungskosten zu berechnen. F\u00fcr den Fall, dass der Auftraggeber die \u00fcbersch\u00fcssigen Materialien abnimmt, fallen keine Entsorgungskosten an.<\/span><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">\n<\/span><span style=\"font-size: 11pt; font-family: 'Open Sans',sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">b) F\u00fcr den Fall, dass der Auftraggeber mehr als 7% \u00fcber der rechnerisch ben\u00f6tigten Menge beistellt, wird der Verk\u00e4ufer den Auftraggeber zun\u00e4chst ansprechen, um \u00fcber eine m\u00f6gliche Erh\u00f6hung der Bestellmenge zu entscheiden. Nach Abschluss der Produktion wird der Verk\u00e4ufer s\u00e4mtliche vom Auftraggeber beigestellten, \u00fcbersch\u00fcssigen Materialien an diesen zur\u00fcckschicken.
